What is Flatswaps?
In many cities, rental markets are effectively stuck. Tenants live in flats that no longer fit their needs but avoid moving because comparable housing on the open market is scarce or unaffordable.
Instead of competing for vacant listings, tenants increasingly look for structured flat swaps — for example when families grow, seniors downsize, remote workers need more space, or students go abroad.
Flatswaps applies a matching-market approach to connect compatible tenants, including multi-party exchanges, increasing the likelihood of stable and mutually beneficial swaps.
For landlords: Swaps can reduce vacancy risk, lower acquisition costs, and improve allocation efficiency — while keeping reliable tenants within a structured and transparent process.
Legal Requirements
Germany - Temporary Swaps
Tenants can temporarily sublet with landlord consent (§540 BGB)
Original tenant remains fully liable for rent and damage
Subletting period typically requires written notification
Landlord cannot unreasonably refuse short-term swaps
Note: Under German law (BGB §540), tenants have the right to sublet with permission. For temporary swaps under 3 months, notification is often sufficient. The original lease remains in effect.
General Principles (All Countries)
Original leases remain in effect: Tenant A remains liable under their lease, Tenant B remains liable under theirs.
Physical occupancy changes: The tenants exchange which unit they physically live in, but remain responsible for their original contracts.
Swap agreements: Tenants sign swap agreements between themselves outlining responsibilities and care of each other's units.
